1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the website at https://getmytsi.org (the "Site") and related online services operated by Tech in Schools Initiative("TSI," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy, which explains how we handle personal information. If you do not agree, do not use the Site.

Separate written agreements — for example, a statement of work, district agreement, or program order signed with a school or organization — may add or override parts of these Terms for those specific engagements. Where there is a conflict, the signed agreement controls for that relationship.

2. Eligibility

The Site is intended for users who can form legally binding contracts. If you use the Site on behalf of a school, district, nonprofit, or company, you represent that you have authority to bind that entity. If you are under 18, you may use the Site only with the involvement and consent of a parent, guardian, or authorized educator as applicable.

3. Permitted use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for lawful purposes: learning about TSI, requesting information, applying for partnerships, purchasing merchandise where offered, making donations, and communicating with us through the channels we provide.

You agree not to misuse the Site. Without limiting the foregoing, you must not:

  • Violate any applicable law or regulation.
  • Infringe intellectual property, privacy, or other rights of TSI or third parties.
  • Attempt to gain unauthorized access to the Site, our systems, user accounts, or connected networks (including probing, scanning, or testing vulnerabilities).
  • Use automated means (scraping, harvesting, bots) in a way that overloads the Site or bypasses restrictions, except as allowed by public search engine indexing at reasonable volumes.
  • Transmit malware, spam, or deceptive or harmful content.
  • Impersonate TSI, our staff, or another person or entity.

4. Accounts, forms, and communications

When you submit forms (such as contact, program request, or partner interest), you agree that information you provide is accurate to the best of your knowledge. You are responsible for maintaining the confidentiality of any credentials we may issue for limited portals or tools, and for activity under your account. Notify us promptly at support@mytsi.org if you believe your access has been compromised.

5. Educational programs and school relationships

Descriptions of programs, outcomes, and partnerships on the Site are for general information. Delivery timelines, staffing, pricing, data handling, and compliance obligations for in-school or district programs are defined in contracts, work orders, or policies agreed with the school or district, and may reference FERPA, state student privacy laws, and district requirements. Nothing on the Site replaces those agreements or individualized legal advice.

6. Intellectual property

The Site and its contents — including text, graphics, logos, curriculum materials made available through authorized channels, software, and design — are owned by TSI or our licensors and are protected by copyright, trademark, and other laws. Except as expressly allowed (e.g., temporary caching for browsing, or fair use), you may not copy, modify, distribute, sell, or create derivative works without our prior written permission.

"Tech in Schools Initiative," "TSI," and related marks are trademarks of TSI. Third-party names and logos belong to their respective owners.

7. User submissions and feedback

If you send us feedback, testimonials, ideas, or other submissions (excluding personal data covered under our Privacy Policy), you grant TSI a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for operating and promoting our mission, unless we agree otherwise in writing. You represent that you have the rights to grant this license.

8. Online store

If we offer merchandise or digital goods for sale, product descriptions, images, and availability are presented as accurately as we can. We may limit quantities, refuse orders, or cancel transactions in cases of pricing errors, suspected fraud, or supply issues. Prices are listed in U.S. dollars unless stated otherwise. Taxes and shipping, if applicable, are shown at checkout or in order communications.

Returns and refunds: For store purchases, contact support@mytsi.org within thirty (30) days of purchase with your order details. We will work with you on replacements or refunds where appropriate; digital goods may be non-refundable once delivered unless required by law.

9. Donations

Donations made through the Site are voluntary. TSI is a nonprofit organization; tax treatment of your contribution depends on your situation and applicable law — consult a tax advisor. Recurring donations can typically be updated or canceled through the payment provider's customer tools or by contacting us. Donations are generally non-refundable except where we determine a processing error occurred or a refund is required by law.

10. Payments

Payments for store orders and donations are processed by Stripe, Inc.and its affiliates. Card and bank data are handled according to Stripe's terms and privacy policy. TSI does not store full payment card numbers on our servers. You agree to pay all charges incurred under your payment method and authorize us and Stripe to charge that method.

11. Third-party services and links

The Site may link to third-party websites, embeds (such as video players), or tools (scheduling, maps, etc.). Those services are governed by their own terms and policies. We are not responsible for third-party content or practices; use them at your own risk.

12. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TSI OR ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TSI FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID US FOR ANYTHING IN THAT PERIOD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT ALLOWED BY LAW.

14. Indemnification

You agree to defend, indemnify, and hold harmless TSI and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of third-party rights.

15. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. For disputes that cannot be resolved informally, you and TSI agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York, except where prohibited by law or where a different venue is mandated for consumers in your jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may also be announced by a notice on the Site or by email where appropriate. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you disagree, you should stop using the Site.

17. Termination

We may suspend or terminate access to the Site or any feature at any time, with or without notice, for conduct that we believe violates these Terms or harms TSI, users, or third parties. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

18. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any separate agreement you enter with TSI for specific services, constitute the entire agreement between you and TSI regarding the Site.
